Terms of Service

By accessing or using SCI Cotek ("Platform"), operated by COTEK FZ LLC ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and subscribers.

SCI Cotek is a scientific data analysis platform designed for environmental and water scientists. The Platform provides tools for uploading, analysing, visualising, and exporting scientific measurement data, as well as AI-powered analysis and collaboration features.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice to registered users.

To access certain features, you must register for an account. You agree to:

- Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Notify us immediately of any unauthorised use of your account at support@cotek.live
• Accept responsibility for all activities that occur under your account

You must be at least 16 years of age to create an account. By registering, you represent that you meet this age requirement.

Free Plan: Available at no cost with usage limits as described on our pricing page. We reserve the right to modify Free plan limits with 30 days' notice.

Pro Plan: A paid subscription at $29/month or $290/year (billed in advance). Pro subscriptions auto-renew unless cancelled.

Payment: Payments are processed by Stripe. By subscribing to a paid plan, you authorise COTEK FZ LLC to charge your payment method on a recurring basis.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods, except as required by applicable law.

Price Changes: We may change subscription prices with 30 days' notice. Continued use after price changes take effect constitutes acceptance of the new pricing.

Free Override Access: We may grant complimentary Pro access at our discretion. This access may be revoked at any time.

You agree not to use the Platform to:

- Upload data that you do not have the right to use or share
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure
• Transmit malware, viruses, or any malicious code
• Scrape, crawl, or extract data from the Platform using automated means
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Use the Platform for any unlawful purpose or in violation of applicable regulations
• Resell, sublicense, or commercialise access to the Platform without our express written consent
• Impersonate any person or entity or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these terms.

Ownership: You retain full ownership of all scientific data, files, and content you upload to the Platform ("Your Content"). We do not claim any intellectual property rights over Your Content.

Licence to Us: By uploading Your Content, you grant COTEK FZ LLC a limited, non-exclusive, worldwide licence to store, process, and display Your Content solely for the purpose of providing the Platform to you.

Data Accuracy: You are responsible for the accuracy, quality, and legality of Your Content. We do not verify or validate the scientific accuracy of your data.

Backup: While we maintain database backups, you are responsible for maintaining your own copies of important data. We are not liable for data loss.

The Platform incorporates AI capabilities powered by third-party services (currently Anthropic Claude). When using AI features:

- AI responses are generated based on patterns in data and are for informational purposes only
• AI-generated reports and recommendations should be reviewed by qualified scientists before use in official reports or regulatory submissions
• We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content
• You are responsible for verifying any AI-generated thresholds, recommendations, or analysis

AI features are subject to usage limits based on your subscription plan.

The Platform, including its design, code, features, and content (excluding Your Content), is the property of COTEK FZ LLC and is protected by intellectual property laws.

The SCI Cotek name, logo, and brand are trademarks of COTEK FZ LLC. You may not use our trademarks without our prior written consent.

Feedback you provide about the Platform may be used by us without obligation to you.

When using Teams features:

- The team owner is responsible for managing member access and permissions
• Sharing datasets with team members grants them access according to the permission level you set
• You are responsible for ensuring that sharing data with others complies with any applicable data protection obligations
• Team invites expire after 7 days
• We are not responsible for how team members use data shared with them

To the maximum extent permitted by applicable law, COTEK FZ LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Platform.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

You agree to indemnify and hold harmless COTEK FZ LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the UAE.

If you are located in the European Union, you may also have rights under EU consumer protection law that cannot be excluded by contract.

We may update these Terms at any time. We will notify you of material changes by email or prominent notice on the Platform at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

You may terminate your account at any time by contacting us at support@cotek.live or through your account settings.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice.

Upon termination, your right to use the Platform ceases immediately. We will delete your data within 30 days of account termination.
